Orbital Assessment Terms
Version 1.0. Effective 1 November 2026.
1. About us
These terms are between you and Orbital Risk Intelligence, a company registered in England and Wales ("Orbital", "we", "us"). You can contact us at info@orbitalriskintelligence.com.
2. What these terms cover
These terms apply to every assessment bought through the Orbital website, including the Voyage Risk Assessment, Port Risk Assessment, Vessel Affiliation Assessment and Sanctions Exposure Assessment (each an "Assessment"). They apply together with your order confirmation. By ticking the acceptance box at checkout, you agree to them.
3. Business customers only
Assessments are sold to businesses only. By placing an order you confirm that you are acting for a business, and that you have authority to accept these terms on its behalf.
4. Ordering and payment
Prices are shown in pounds sterling and exclude VAT, which is added where applicable. Payment is taken in full at checkout through our payment provider. A contract is formed when your payment is confirmed and we send your order confirmation.
5. Delivery
After payment you will be given access to the Orbital platform to complete the Assessment. You must provide complete and accurate information, including vessel, voyage and operational details. The Assessment is based on the information you give us, and we are not responsible for errors that result from information that is incomplete or inaccurate.
Most Assessments are produced on completion of the questionnaire. Some require analyst review, and we will tell you when this applies. Delivery times are estimates.
6. Nature of the Assessment
An Assessment is a professional intelligence assessment, based on the information available to us at its stated intelligence cut-off and on our analytical judgement. It is not a guarantee of safety or of any outcome.
An Assessment does not replace the authority of the master, your company security procedures, flag state or naval guidance, or legal, insurance or sanctions compliance advice. You remain responsible for all operational, commercial and compliance decisions.
7. Validity
An Assessment is valid as at its time of delivery. It is subject to change according to geopolitical and security developments. A material change, including to the route, timing, port calls, vessel, cargo, security arrangements or the threat environment, may mean the Assessment no longer applies. We are not obliged to update an Assessment after delivery unless we have agreed to do so in writing.
8. Licence and permitted use
All intellectual property in an Assessment remains with Orbital. On payment, we grant you a non-exclusive, non-transferable licence to use the Assessment for your internal business purposes.
The Assessment may be used only by the purchasing company and by the master and crew of the vessel it concerns. You must not forward, distribute, republish, resell or otherwise make it available to any other person without our prior written consent. Assessments may carry identifying marks so that their source can be traced.
9. Your account
You are responsible for keeping access to your Orbital account secure, and for all use of the account. Tell us promptly if you believe it has been accessed without authority.
10. Cancellation and refunds
You may cancel an order for a full refund if you have not yet submitted the Assessment questionnaire, by emailing info@orbitalriskintelligence.com within 14 days of payment. Once the questionnaire has been submitted, the fee is non-refundable, except where we fail to deliver the Assessment.
11. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
Subject to that, we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, business, contracts, charter hire or goodwill, however caused. We are not liable for any loss or damage to a vessel, cargo, persons or property arising from hostile acts, piracy, terrorism, war, sanctions measures or other security events, whether or not described in an Assessment.
Our total liability to you arising from or in connection with an Assessment, whether in contract, tort (including negligence) or otherwise, is limited to the fee you paid for that Assessment.
12. Events outside our control
We are not responsible for any delay or failure to perform caused by events outside our reasonable control.
13. Data protection
We handle personal data in line with our Privacy Policy.
14. Changes to these terms
We may update these terms from time to time. The version in force when you placed your order applies to that order.
15. Governing law
These terms, and any dispute arising from them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
